Privacy Notice
Last updated: 26 July 2026. This Privacy Notice explains how KADAK Energy collects, uses, shares, retains and protects personal information in connection with kadakenergy.com (the “Site”), our submission and investor-intake workflows, and related communications. It should be read together with our Terms of Use and Disclosures.
1. Overview & scope
We are committed to processing personal information responsibly and only as necessary to operate the Site, evaluate opportunities, communicate with counterparties, onboard qualified investors, and comply with legal and regulatory obligations. This Notice applies to information collected through the Site and through direct interactions with our team.
This Notice does not apply to information collected by affiliated but separately governed platforms, third-party websites linked from the Site, or offline processes governed by their own confidentiality or contractual terms.
2. Data controller
For the purposes of applicable data-protection laws, KADAK Energy acts as the data controller (or business, as applicable) of the personal information described in this Notice. Contact details are set out in section 15 below.
3. Information we collect
We collect information in the following categories:
- Identity & contact: name, title, organisation, business email, phone, country and preferred language.
- Opportunity submissions: project or company details, technology, geography, capacity, stage, capital sought, commercial context and any files or attachments you upload.
- Investor-intake information: investor category, jurisdiction, mandate, ticket size, eligibility representations and diligence responses required to assess qualification.
- Account & authentication: for authenticated areas, credentials and session identifiers managed via our backend authentication provider.
- Correspondence: emails, notes, referrals and other communications you send to us.
- Technical & usage data: IP address, device and browser type, referrer, timestamps, pages viewed and interactions with the Site.
4. How we use information
We use personal information to:
- operate, secure and improve the Site;
- evaluate, triage and progress opportunities, referrals and investor-access requests through our internal pipeline;
- verify investor qualification and satisfy know-your-customer, anti-money-laundering and sanctions requirements;
- communicate with you, respond to enquiries, and send service-related notifications and, where permitted, insights content you request;
- maintain records, exercise or defend legal claims, and comply with legal, regulatory and audit obligations; and
- detect, prevent and address fraud, abuse, malicious activity and security incidents.
5. Legal bases for processing
Where the GDPR, UK GDPR or an equivalent framework applies, we rely on the following legal bases: (a) performance of a contract or taking pre-contractual steps at your request; (b) compliance with a legal obligation; (c) our legitimate interests in operating an institutional infrastructure platform, evaluating opportunities, and protecting the Site and our counterparties; and (d) your consent, where required (for example, for optional analytics or marketing communications). Where processing is based on consent, you may withdraw consent at any time.
7. Service providers & subprocessors
We engage vetted service providers to host and operate the Site and our workflows, including cloud database, storage, authentication, email delivery, analytics and productivity providers. These providers process personal information on our behalf under contractual terms that restrict use to our documented instructions and require appropriate security safeguards.
8. International data transfers
KADAK Energy Systems operates across multiple jurisdictions. Personal information may be transferred to, stored in, or processed in countries other than your country of residence, including jurisdictions whose data-protection laws may differ. Where required, we implement appropriate safeguards for cross-border transfers, such as standard contractual clauses or equivalent mechanisms.
9. Retention
We retain personal information for as long as necessary to fulfil the purposes for which it was collected, including to satisfy legal, accounting, audit, tax, regulatory or dispute-resolution requirements. Retention periods vary based on the category of information and the context of the relationship. Opportunity submissions and diligence records are typically retained for the life of the evaluation plus a reasonable archival period thereafter.
10. Security
We implement administrative, technical and organisational measures designed to protect personal information against unauthorised access, alteration, disclosure and loss. These include role-based access, encrypted transport, row-level access controls on our backend datastore, virus-scanning controls on uploaded files, and least-privilege access for internal personnel. No system, however, can be guaranteed to be fully secure, and you use the Site at your own risk.
12. Your rights
Subject to applicable law, you may have the right to (a) access personal information we hold about you, (b) request correction of inaccurate information, (c) request deletion of information, (d) request restriction of, or object to, certain processing, (e) request portability of information you provided, (f) withdraw consent where processing is based on consent, and (g) lodge a complaint with your local supervisory authority. California residents have additional rights under the CCPA/CPRA, and residents of India have rights under the DPDPA. To exercise any of these rights, contact us at admin@kadakfund.com. We will respond within the timeframe required by applicable law and may need to verify your identity before acting on your request.
13. Children
The Site is directed to institutional users and is not intended for children. We do not knowingly collect personal information from children under 16.
14. Changes to this notice
We may update this Notice from time to time. The most current version will always be posted on this page with an updated “Last updated” date. Material changes will be communicated through the Site or, where appropriate, by direct notice.
